Terms of Service

Effective Date: January 19, 2026

These Terms of Service ("Terms") govern your use of the Psyche platform at psyche.you (the "Platform"), operated by PSYCHE PROJECT PBC ("Psyche," "we," "us," or "our"), a Delaware Public Benefit Corporation.

By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.


1. Eligibility

To use the Platform, you must:

  • Be at least 13 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Platform under applicable law

By using the Platform, you represent and warrant that you meet these requirements.


2. Account Registration

2.1 Account Requirements

An account is required to access most Platform features, including taking assessments and viewing your results. Some limited features may be accessible without an account. When you create an account, you agree to provide accurate, current, and complete information during registration.

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access at support@psyche.you

We are not liable for any loss resulting from unauthorized use of your account.

2.3 One Account Per Person

Each user may maintain only one account. We reserve the right to terminate duplicate accounts.


3. Description of Services

Psyche provides a psychological assessment platform that includes:

  • Cognitive Assessments: Interactive tasks measuring cognitive abilities such as working memory, attention, and processing speed
  • Personality Questionnaires: Validated surveys measuring personality traits, wellbeing, and psychological characteristics
  • Personalized Profiles: AI-generated insights and visualizations based on your assessment results
  • Progress Tracking: Tools to monitor changes in your results over time
  • Normative Comparisons: Optional comparisons to population norms when demographic information is provided

3.1 Free and Premium Services

The Platform currently offers free access to assessments and features. We may introduce premium features or subscription plans in the future. Any paid services will be subject to additional terms presented at the time of purchase.


4. Important Disclaimers

4.1 Not a Diagnostic Tool

THE PLATFORM IS NOT A DIAGNOSTIC TOOL. Assessment results are provided for personal insight, self-exploration, and educational purposes only. Results do not constitute:

  • A medical or psychological diagnosis
  • Clinical advice or treatment recommendations
  • A substitute for professional evaluation

4.2 Not Professional Advice

Nothing on the Platform should be construed as professional psychological, medical, or mental health advice. If you have concerns about your mental health, please consult a qualified healthcare professional.

4.3 Result Variability

Your assessment results may vary based on factors including:

  • Current mood, stress, or fatigue levels
  • Time of day and environmental conditions
  • Device type and internet connection quality
  • Familiarity with assessment tasks (practice effects)

Results represent a snapshot in time and should be interpreted with these limitations in mind.

4.4 AI-Generated Content

Some features use artificial intelligence to generate insights and narratives. AI-generated content:

  • Is based on statistical patterns and may not perfectly reflect your individual circumstances
  • Should be considered as one perspective, not definitive truth
  • May occasionally produce unexpected or imperfect results

5. Acceptable Use

5.1 You Agree To

  • Use the Platform only for lawful purposes
  • Provide honest and accurate responses to assessments
  • Respect the intellectual property rights of Psyche and others
  • Maintain the security of your account

5.2 You Agree Not To

  • Misrepresent your identity or provide false information
  • Attempt to manipulate or game assessments to achieve particular results
  • Use the Platform for unauthorized research or commercial purposes
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform
  • Interfere with or disrupt the Platform's operation or security
  • Use automated systems (bots, scrapers) to access the Platform
  • Violate any applicable laws or regulations
  • Harass, abuse, or harm others through the Platform

5.3 Enforcement

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice or liability.


6. Intellectual Property

6.1 Our Property

The Platform, including all content, features, assessments, algorithms, and software, is owned by Psyche or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Platform without our written permission.

6.2 Your Content

You retain ownership of any content you submit (such as feedback). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content to operate and improve the Platform.

6.3 Assessment Data

Your assessment responses and results are your personal data, subject to our Privacy Policy. However, the assessment instruments, scoring algorithms, and normative data are our intellectual property.


7. Research Participation

7.1 Optional Consent

You may choose to contribute your anonymized data to research through your account settings. This is entirely voluntary and does not affect your access to the Platform.

7.2 How Data Is Used

If you consent, your de-identified data may be:

  • Used to build and validate normative datasets
  • Licensed to academic and research institutions
  • Used to train AI models for improved assessment accuracy
  • Included in aggregate research findings

7.3 Withdrawal

You may withdraw your research consent at any time. Previously anonymized data that has already been incorporated into datasets cannot be removed, as it is no longer linked to your identity.

8. Privacy

Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, and protect your information. By using the Platform, you consent to our data practices as described therein.


9. Disclaimers and Limitations of Liability

9.1 "As Is" Basis

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF RESULTS

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSYCHE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, or goodwill
  • Any damages arising from your use of or inability to use the Platform
  • Any decisions or actions you take based on Platform results

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR (B) $100 USD.

9.3 Basis of the Bargain

You acknowledge that these limitations are an essential part of these Terms and that we would not provide the Platform without them.


10. Indemnification

You agree to indemnify, defend, and hold harmless Psyche and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at support@psyche.you and attempt to resolve any dispute informally for at least 30 days.

11.2 Binding Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration, administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will be conducted:

  • On an individual basis (not as a class action)
  • In English
  • Either in person in Delaware, by telephone, or via written submissions (as determined by the arbitrator)

The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND PSYCHE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11.4 Exceptions

The following disputes are not subject to arbitration:

  • Claims that may be brought in small claims court
  • Disputes regarding intellectual property rights
  • Claims for injunctive relief to prevent unauthorized use or abuse of the Platform

11.5 Opt-Out

You may opt out of the arbitration agreement by sending written notice to support@psyche.you within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts located in Delaware.


12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any litigation not subject to arbitration shall be brought exclusively in the state or federal courts located in Delaware.


13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page with a new effective date
  • Sending an email to registered users (for significant changes)

Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Platform and delete your account.


14. Termination

14.1 By You

You may terminate your account at any time through your account settings or by contacting support@psyche.you.

14.2 By Us

We may suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, extended inactivity, or discontinuation of the Platform.

14.3 Effect of Termination

Upon termination:

  • Your right to use the Platform ceases immediately
  • We will delete your personal data in accordance with our Privacy Policy
  • Provisions that by their nature should survive (such as intellectual property, limitation of liability, and dispute resolution) will remain in effect

15. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Psyche regarding the Platform.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.

15.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder. We may assign these Terms without restriction.

15.5 No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Psyche.
